In Florida, many different types of sexual behavior are prohibited. The most serious of sex crimes is sexual battery. It’s the sex crime that the public knows best as simply rape.
Two football players from the University of Miami have been arrested on sexual battery charges. They were arrested because they allegedly sexually assaulted a “physically helpless” 17-year-old girl. They have been dismissed from the team and suspended. Both men are 20-year-old linebackers.
According to the police report, both men admitted to buying drinks for the teen girl. Then they brought her back to their dorm room in the early-morning hours of Saturday and repeatedly performing sexual acts, including intercourse, without her consent while she was intoxicated and “physically helpless to resist.” Both players are being held on $10,000 bond. To make matters worse, one of them was additionally charged with possession of a stolen or forged driver’s license.
They currently don’t have any legal representation, but they will be in desperate need of some immediately. Sexual assault cases are often complicated by contradictory reports, so this does give a defense attorney something to work with. This is always a complicated matter, especially when it involves two parties with disputing facts about serious emotional issues. A lack of viable witnesses can sometimes lead to false or exaggerated statements, but if there is damning evidence involved, then that is another matter. These young men could end up in jail or on a sex offenders’ list, if they don’t get proper legal advice.
