You Have Only 10 Days To Protect Your License

What You Can Expect At The DHSMV Hearing

The purpose of the formal review hearing is to challenge the validity of the driver’s license suspension. If you do not set this hearing up within the 10 days, you will waive your right to contest the suspension and you will lose your license for the set period of time.

These DHSMV hearings are not held in front of a judge; they are conducted by a hearing officer who is a DHSMV employee. At the hearing, the arresting officer and sometimes the officer who asked you to submit to a blood, breath or urine test is required to be subpoenaed and proof of that must be shown to the hearing officer.

At this hearing, your lawyer must prove that the officer did not have probable cause or reasonable suspicion to stop your vehicle, that the officer did not have probable cause to conduct field sobriety exercises and that the officer did not have probable cause to arrest you for DUI, which would result in the officer not having probable cause to request that you submit to a breath, blood or urine test.
